The regular meeting of the Council of the Corporation of the Municipality of Magnetawan was held at the Magnetawan Community Centre on Wednesday, November 9, 2016 at 1:00 p.m.

 

Council members present: Mayor Sam Dunnett; Councillors Tim Brunton, Jack Crossman, Charlie Gray, and John Hetherington.

 

Staff in attendance: Clerk-Administrator (C-A), Andrew Farnsworth; Fire Chief/By-law Enforcement/CEMC, Dean Butticci.

 

Notice of this meeting was posted on the Municipal website and at the Municipal Office.

 

1. CALL TO ORDER

The meeting was called to order at 1:00 P.M.

2. ADOPTION OF THE AGENDA

RESOLUTION  2016-336

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan adopts the agenda for this regular Council meeting of Wednesday, November 9, 2016. (Carried)

4. ADOPTION OF MINUTES

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan adopts the minutes of the regular Council meeting of Wednesday, October 26, 2016. (Carried)

5. PUBLIC MEETING PURSUANT TO THE PLANNING ACT

5.1. Charles and Patricia Comartin: Zoning By-law Amendment, 116 Bells Bay Trail

Mayor Dunnett opened the public meeting at 1:05 P.M. under Section 34 of the Planning Act. The purpose of the meeting was to provide information regarding a proposed zoning by-law amendment to zone lands legally described as Part of Lot 2, Concession 14 in the geographic Township of Spence, now in the Municipality of Magnetawan, from the “Shoreline Residential” (RS) Zone to the “Shoreline Residential Exception Twenty Four” (RS-24) Zone.

No comment had been received by the Municipality regarding the proposed zoning amendment. The Mayor asked for comment from Council, from the Applicant, and from the public, of which there was none.

The Mayor advised the applicant that the by-law would be considered under agenda item 8.1.

The Mayor closed the public meeting at 1:08 P.M.

 

5.2. Susan Phillips, agent for Jan Kuczek: Zoning By-law Amendment, 255 Chikopi Road

Mayor Dunnett opened the public meeting at 1:08 P.M. under Section 34 of the Planning Act. The purpose of the meeting was to provide information regarding a proposed zoning by-law amendment to zone lands legally described as Part of Lot 11, Concession 7 in the geographic Township of Croft, now in the Municipality of Magnetawan, from the “Rural” (RU) Zone to the “Rural Residential” (RR) Zone as a condition of consent approval.

No comment had been received by the Municipality regarding the proposed zoning amendment. The Mayor asked for comment from Council, from the Applicant, and from the public, of which there was none.

The Mayor advised the applicant that the by-law would be considered under agenda item 8.2.

The Mayor closed the public meeting at 1:10 P.M.

7. REPORTS FROM MUNICIPAL BOARDS, COMMITTEES, AND OFFICIALS

7.1. Treasury Department

7.1.1. Vesting of land – Pt Lot 97 Con B Chapman, Pt 27 42R4109, Magnetawan

RESOLUTION  2016-338

Moved by Councillor Brunton; Seconded by Councillor Crossman:

WHEREAS the Municipal Tax Sales Act, R.S.O. 1990, chapter M.60, as amended, allows a municipality to register a tax arrears certificate against the title to the land with respect to which the tax arrears are owing; AND WHEREAS Section 9(3)(b) of the Municipal Tax Sales Act provides for the treasurer to conduct a public sale of the land; and where there is no successful purchaser, the treasurer may prepare and register, in the name of the municipality, a notice of vesting for the land; AND WHEREAS the treasurer conducted a public sale of land, concluding at 3:00 P.M. Monday, October 17, 2016, for which there was no successful purchaser; NOW THEREFORE BE IT RESOLVED THAT the Council of the Municipality of Magnetawan authorizes the Treasurer to register a notice of vesting for the following lands: Pt Lot 97 Con B Chapman, Pt 27 42R109, Magnetawan, being all of PIN 52081-0482 (LT), roll number 494401000311201. (Carried)

7.1.2. Review of reserves budgets

7.1.3. Road construction debenture

RESOLUTION  2016-339

Moved by Councillor Brunton; Seconded by Councillor Hetherington:

WHEREAS the Council of the Municipality approved the 2016 budget including a bank loan in the amount of $1,300,000.00 for the reconstruction and resurfacing of Nipissing and Ahmic Lake Roads; AND WHEREAS Magnetawan has entered into a loan agreement for construction financing with Infrastructure Ontario, with the final debenture amount yet to be confirmed; NOW THEREFORE BE IT RESOLVED THAT the Council of the Municipality of Magnetawan authorizes 10-year financing through Infrastructure Ontario in the amount of $1,300,000.00, with any unfunded portion of the $1,300,000.00 budgeted amount to be transferred from reserves. (Carried)

7.3.1. Community Development Officer Intern (CDOI) monthly report

7.3.2. Township of Perry: cell phone for CDOI

RESOLUTION  2016-330

Moved by Councillor Gray; Seconded by Councillor Brunton:

WHEREAS the Joint Economic Development Committee (KPMM) has revisited the provision of a cell phone for the Community development Officer Intern (CDOI); AND WHEREAS during 2016 budget considerations, the four member Councils did not support the provision of a cell phone for the CDOI position; AND WHEREAS the four member Councils did support contributing to the cost of a personal cell phone in an amount not to exceed $20.00 per month; AND WHEREAS the CDOI’s cell phone costs have exceeded the budgeted amount; AND WHEREAS the KPMM is recommending that a cell phone plan be put in place under Perry Township for November and December 2016, with costs to be between $22.85 and $55.00 per month and split between the member municipalities which are in support of the cell phone; AND WHEREAS the Town of Kearney and the Township of McMurrich/Monteith do not support the provision of a CDOI cell phone; NOW THEREFORE BE IT RESOLVED THAT  the Council of the Municipality of Magnetawan approves the use of a Perry Township cell phone for the CDOI with costs to be shared between participating KPMM municipalities. (Carried)

7.3.3. Township of Perry: draft CDOI Agreement

Council directed the C-A to prepare a draft 2017 work plan for Community Economic Development for presentation to Council.

7.4. Fire Department

7.4.1. Fire Chief monthly report

Council directed the Fire Chief to place an advertisement for volunteer recruitment. Council requested follow up information to supplement the monthly report, including training records and detailed call statistics.

7.4.2. Renewal of Regional Fire Training contract

Council directed the Fire Chief to provide a report on the contract and training for the next regular meeting.

RESOLUTION  2016-330

Moved by Councillor Brunton; Seconded by Councillor Crossman:

WHEREAS the Regional Fire Training Services contract with James Gary Courtice expires on June 30, 2017; AND WHEREAS Mr. Courtice has agreed to provide the five participating fire departments with services to the end of 2017, with the 2017 annual cost being the same as in 2016; NOW THEREFORE BE IT RESOLVED THAT the Council of the Municipality of Magnetawan approves the extension of the Regional Fire Training Services contract to December 31, 2017; AND FURTHER THAT the Mayor and Clerk-Administrator be authorized to sign the updated Regional Fire Training Services Agreement on behalf of Magnetawan, provided that the new Agreement contains no other substantial changes. (Deferred)

Council reviewed the draft Sick Days Policy and requested that the C-A make several changes to be incorporated into the final version.

7.6. Meeting Minutes – Central Almaguin Planning Board, October 12, 2016

WHEREAS the Municipality of Magnetawan has received an application from Charles and Patricia Comartin to rezone lands municipally known as 116 Bells Bay trail, Magnetawan; AND WHEREAS Council has given consideration to the comments that have been received in regard to this application; NOW THEREFORE BE IT RESOLVED THAT the Council of the Municipality of Magnetawan adopts By-law 2016-40, being a By-law to amend By-law No. 2001-26, as amended, the Zoning By-law for the Corporation of the Municipality of Magnetawan, with respect to lands located at Part of Lot 2, Concession 14 in the geographic Township of Spence, now in the Municipality of Magnetawan, municipally known as 116 Bells Bay Trail, Magnetawan. WHEREAS the Municipality of Magnetawan has received an application from Susan Phillips, agent for Jan Kuczek, to rezone lands municipally known as 255 Chikopi Road, Magnetawan; AND WHEREAS Council has given consideration to the comments that have been received in regard to this application; NOW THEREFORE BE IT RESOLVED THAT the Council of the Municipality of Magnetawan adopts By-law 2016-41, being a By-law to amend By-law No. 2001-26, as amended, the Zoning By-law for the Corporation of the Municipality of Magnetawan, with respect to lands located at Part of Lot 11, Concession 7 in the geographic Township of Croft, now in the Municipality of Magnetawan, municipally known as 255 Chikopi Road, Magnetawan. RESOLUTION 2016-348

Moved by Councillor Gray; Seconded by Councillor Hetherington:

WHEREAS the Municipality of Magnetawan has received a request to support the Magnetawan Agricultural Society 2017-2020 Fall Fair Regular Prize Book through a donation in the form of an advertisement in the book; NOW THEREFORE BE IT RESOLVED THAT the Council of the Municipality of Magnetawan approves a donation of $400.00 for a one-half page advertisement in the Magnetawan Agricultural Society 2017-2020 Prize Book. (Carried)

9.3. Grey County: resolution to request re-evaluation of hydro in rural communities

RESOLUTION  2016-349

Moved by Councillor Crossman; Seconded by Councillor Brunton:

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan supports the attached letter and resolution from Grey County requesting that the province re-evaluate the structure of hydro in terms of access and delivery, and implement structural changes to address the unfair practice of charging more for delivery for rural residents; AND FURTHER THAT this resolution be forwarded to the Hon. Kathleen Wynne, Premier of Ontario; HON. Glenn Thibeault, Minister of Energy; Norm Miller, MP Parry Sound-Muskoka; the Association of Municipalities of Ontario (AMO); Ontario Small Urban Municipalities (OSUM; and Grey County. (Carried)

9.5. The Lung Association: proclamation of November as Lung Month

RESOLUTION  2016-350

Moved by Councillor Gray; Seconded by Councillor Crossman:

WHEREAS one in five Ontario residents lives with lung disease; AND WHEREAS lung disease is one of the most prevalent, deadly and costly chronic diseases; AND WHEREAS the advancement and protection of the health of our citizens must continue to be a priority for all levels of government; AND WHEREAS to increase awareness of lung health issues and to inform Ontarians about the importance of their lung health, the Ontario Lung Association has designated the month of November “Lung Month”; NOW THEREFORE BE IT RESOLVED THAT the Council of the Municipality of Magnetawan proclaims November 2016 as “Lung Month” in Magnetawan.
