The regular meeting of the Council of the Corporation of the Municipality of Magnetawan was held at the Magnetawan Community Centre on Wednesday, July 26, 2017 at 1:00 P.M.

 

Council members present: Mayor Sam Dunnett; Deputy Mayor, Tim Brunton; Councillors Jack Crossman, Charlie Gray, John Hetherington.

 

Staff in attendance: Clerk-Administrator (C-A), Andrew Farnsworth;  Deputy Clerk (DC), Nicole Fraser.

 

Notice of this meeting was posted on the Municipal website and at the Municipal Office.

 

1. CALL TO ORDER

The meeting was called to order at 1:00 P.M.

2. ADOPTION OF THE AGENDA

RESOLUTION  2017-220

Moved by Councillor Hetherington; Seconded by Councillor Gray:

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan adopts the agenda for this regular Council meeting of Wednesday, July 26, 2017. (Carried)

4. ADOPTION OF MINUTES

RESOLUTION  2017-221

Moved by Councillor Crossman; Seconded by Councillor Hetherington:

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan adopts the minutes of the regular Council meeting of Wednesday, July 12, 2017. (Carried)

Council directed the C-A to have the Fire Chief attend the next regular meeting to discuss Magnetawan Fire Department training needs.

 

7.3. Parks and Maintenance:

7.3.1. Parks Lead Hand position during Parks and Maintenance Manager absence

RESOLUTION  2017-222

Moved by Councillor Brunton; Seconded by Councillor Gray:

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan approves the payment of a $2.00/hr Lead Hand bonus to Logan Bigelow for those times that the Parks and Maintenance Manager (PMM) is on vacation or is ill; AND FURTHER THAT the PMM or Clerk-Administrator shall define such absences that are eligible for the Lead Hand bonus; AND FURTHER THAT the Lead Hand bonus shall be paid retroactive to July 14, 2017. (Carried)

7.4. Community Development and Recreation:

7.4.1. Support in principle for Regional Community Economic Development

RESOLUTION  2017-223

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan supports in principle the establishment of an Almaguin Highlands Regional Community and Economic Development Department. (Carried)

7.5. Administration:

7.5.1. Receive lands gift from Tomasz Muszynski – Nelson Lake Road

RESOLUTION  2017-224

Moved by Councillor Gray; Seconded by Councillor Crossman:

WHEREAS  the Municipality of Magnetawan has jurisdiction over the public highway known as Nelson Lake Road; AND WHEREAS  the Municipality does not have paper title to the lands upon which Nelson Lake Road is located; AND WHEREAS  the Municipality wishes to accept the title to that portion of the road described as Part of Lots 11, 12 and 13, Concession 12, in the Geographic Township of Spence, now in the Municipality of Magnetawan, Parts 1 and 2, Plan 42R-20754 (“the Lands”); NOW THEREFORE BE IT RESOLVED THAT  the Council of the Municipality of Magnetawan authorizes the Mayor and Clerk-Administrator to execute such documentation to effect the transfer of the Lands to the Municipality of Magnetawan. (Carried)

7.5.2. Burk’s Falls and District Historical Society request for letter of support

RESOLUTION  2017-225

Moved by Councillor Hetherington; Seconded by Councillor Brunton:

BE IT RESOLVED THAT  the Council of the Municipality of Magnetawan authorizes the Burk’s Falls and District Historical Society to sell raffle tickets on Sunday, August 6, 2017 at Centennial Park, Magnetawan during the Cecebe Waterways Association Regatta; AND FURTHER THAT the Burk’s Falls and District Historical Society shall only sell tickets in accordance with the requirements of their lottery license as issued by the Township of Armour and all relevant requirements of the Alcohol and Gaming Commission. (Carried)

 

7.5.3. Discussion of potential for natural gas expansion into Magnetawan

7.5.4. FCM Asset Management funding application

RESOLUTION  2017-226

Moved by Councillor Crossman; Seconded by Councillor Gray:

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan authorizes the Clerk-Administrator to apply for a grant opportunity from the Federation of Canadian Municipalities (FCM) Municipal Asset Management Program (MAMP) for the Collection of Asset Management Data; AND FURTHER THAT  the Municipality of Magnetawan commits to conducting the following activities in the proposed project submitted to the FCM MAMP to advance our asset management program: 1. roadway condition assessments; 2. roadway traffic counts; 3. culvert GPS survey; AND FUTHER THAT  the Municipality of Magnetawan commits $10,000 from its budget toward the costs of this initiative. 8.1. RESOLUTION 2017-228

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan adopts By-law 2017-39, being a By-law to appoint an Acting Chief Building Official for Part 3 Buildings. (Carried)

 

8.2. RESOLUTION 2017-229

Moved by Councillor Brunton; Seconded by Councillor Crossman:

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan adopts By-law 2017-40, being a By-law to amend By-law 2010-44 Site Plan Control Areas. (Carried)

 

8.3. RESOLUTION 2017-230

Moved by Councillor Gray; Seconded by Councillor Hetherington:

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan adopts By-law 2017-41, being a By-law to enter into a Site License Agreement with Bell Mobility Inc. for the use of a communications tower. (Carried)

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan adopts By-law 2017-42, being a By-law to confirm the proceedings of Council at the regular meeting of Wednesday, July 12, 2017. (Carried)

 

9. CORRESPONDENCE

9.1. Parry Sound Community Business and Development Centre: request for support

RESOLUTION 2017-232

Moved by Councillor Hetherington; Seconded by Councillor Brunton:

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan approves a donation to the Parry Sound Area Community and Business Development Centre in the amount of $1,000.00. (Carried)

9.3. Township of South Algonquin: investigation of EMS Station feasibility

RESOLUTION  2017-233

Moved by Councillor Brunton; Seconded by Councillor Crossman:

BE IT RESOLVED THAT  the Council of the Municipality of Magnetawan supports the attached resolution from the Township of South Algonquin requesting that the Ministry of Health investigate the feasibility of adding a TWOMO-funded EMS station to cover Algonquin Park; AND FURTHER THAT  this resolution be forwarded to the Hon. Eric Hoskins, Minister of Health; the District of Nipissing Social Services Administration Board; and the Township of South Algonquin. (Carried)

 

9.4. Canadian Association of Nuclear Host Communities: request for resolution of support

RESOLUTION  2017-234

Moved by Councillor Gray; Seconded by Councillor Crossman:

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan supports the attached letter from the Canadian Association of Nuclear Host Communities in support of the development of a Deep Geologic Repository at the Bruce Nuclear site. (Defeated)

 

9.5. City of Owen Sound: request for support, re. analysis of changes to employment standards

RESOLUTION  2017-235

Moved by Councillor Crossman; Seconded by Councillor Hetherington:

BE IT RESOLVED THAT  the Council of the Municipality of Magnetawan supports the attached resolution from the City of Owen Sound requesting that the Government of Ontario conduct an Economic Impact Analysis of proposed reforms to the Employment Standards Act prior to implementation; AND FURTHER THAT  this resolution be forwarded to the Hon. Kathleen Wynne, Premier of Ontario; the Hon. Charles Souza, Minister of Finance; the Hon. Kevin Flynn, Minister of Labour; Norm Miller, MPP Parry Sound-Muskoka; the Rural Ontario Municipal Association (ROMA); the Federation of Northern Ontario Municipalities (FONOM); the Association of Municipal Managers, Clerks and Treasurers of Ontario (AMCTO) and the City of Owen Sound. BE IT RESOLVED THAT the Council of the Municipality of Magnetawan approves for payment the Accounts Payable for the period July 1, 2017 to July 15, 2017 in the amount of $237,721.33. (Carried)

BE IT RESOLVED THAT  the Council of the Municipality of Magnetawan moves to a closed session at 3:00 P.M., pursuant to Section 239(2) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, as the subject matter being considered consists of: (c) acquisition or disposition of lands (being to discuss the acquisition of lands in the Municipality). (Carried)

RESOLUTION 2017-238

BE IT RESOLVED THAT the Council of the Municipality of Magnetawan returns to open session at 3:30 P.M. (Carried)

 

The C-A was directed to carry out such directions as were provided by Council during the closed session.
