BY-LAW 2012-23
TAKE NOTICE that the Council of the Corporation of the Municipality of Magnetawan passed By-law 2012-23 on the 10th day of October, 2012, under Section 34 of the Planning Act, R.S.O., 1990, c.P.13 as amended.
By-law 2012-23 amends Zoning By-law 2001-26 and applies to all lands within the Municipality of Magnetawan. For that reason no Key map has been provided.
The purpose of this By-law is to update the Definitions section of the By-law and to amend the provisions for Non-Complying Buildings. The By-law does not change the zoning of any lands. A complete copy of the By-law is available for review in the municipal office during normal working hours.
Any person or agency may appeal to the Ontario Municipal Board in respect to the By-law by filing with the CAO/Clerk of the Corporation of the Municipality of Magnetawan no later than the 7th day of November, 2012. A notice of appeal must set out the reasons for the appeal and must be accompanied by the prescribed fee of $125.00. Cheques are to made payable to the Minister of Finance.
The following shall apply with respect to an appeal:
i. Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
ii. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.
