FOR A ZONING BY-LAW AMENDMENT

AND RECEIPT OF COMPLETE APPLICATION

TAKE NOTICE that the Municipality of Magnetawan has received a complete application to amend Municipal Zoning By-law 2001-26. The application affects lands located on Lot 18, Concession 5 in the former geographic Township of Croft, now in the Municipality of Magnetawan and municipally known as Plan 42R-4545, Part 1, Magnetawan, and legally described as Part of Lot 18, Concession 5 in the geographic Township of Croft, now in the Municipality of Magnetawan, in the District of Parry Sound (see attached Key Map). The purpose of the application to re-zone the subject lands from the Shoreline Residential Zone (RS) to the Shoreline Residential Exception Twenty (RS-25) Zone.

AND PURSUANT to Section 34 (10) of the Planning Act, the application file is available for review at the Municipal Office. Please contact the Clerk to arrange to review this file.

NOTICE OF PUBLIC MEETING WITH COUNCIL

TAKE NOTICE that the Council for The Corporation of the Municipality of Magnetawan will be holding a public meeting under Section 34 of the Planning Act, R.S.O. 1990, Chapter 13 as amended, to inform the public of a proposed Zoning By-law Amendment.


The public meeting is being held for the application described below to enable interested members of the public to understand and comment on a Zoning By-law Amendment which will provide the applicant with the legal permission to develop the subject lands for residential use with no frontage on an improved public road.

DETAILS OF THE ZONING BY-LAW AMENDMENT


The purpose of the proposed by-law is to amend Zoning By-Law No. 2001-26 Schedule ‘A-1’ as amended, to certain lands located on Part of Lot 18, Concession 5 in the former geographic Township of Croft, now in the Municipality of Magnetawan.


The application, if approved, would rezone the subject lands from the Shoreline Residential Zone (RS) to a Shoreline Residential Exception Zone (RS-25) to allow for the subject lands to be developed for residential use with no frontage on an improved public road.


A copy of the proposed Zoning By-law Amendment is available at the Municipality of Magnetawan Municipal Office for public review.

ADDITIONAL INFORMATION AND MAP OF LAND SUBJECT TO THE APPLICATIONS


A key map showing the land to which the proposed amendment applies is provided in this Notice.


The purpose of this meeting is to ensure that sufficient information is made available to enable the public to generally understand the applicant’s proposed Zoning By-law Amendment. Any person who attends the meeting shall be afforded an opportunity to make representations in respect of the application.  Council will then use the information collected at this meeting to make a decision on the Zoning By-law Amendment at a future meeting.


If you wish to be notified of the decision of the Council for the Corporation of the Municipality of Magnetawan in respect to the proposed Zoning By-law Amendment, you must submit a written request (with forwarding addresses) to the Clerk of the Municipality of Magnetawan at Box 70, 4304 Highway 520, Magnetawan, Ontario, P0A 1P0. If a person or public body does not make oral submissions at a public meeting or make written submissions to Council before the proposed By-law is approved, the person or public body is not entitled to appeal the decision of Planning Board to the Ontario Municipal Board.


If a person or public body does not make oral submissions at a public meeting or make written submissions to Council before the proposed By-law is approved, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.


The draft zoning amendment is available to the public for inspection at the Municipality of Magnetawan Municipal Office on Monday to Friday, between the hours of 9:00 a.m. and 12:00 pm, 1:00 pm and 4:30 p.m.
