Amendment to Zoning By-law no. 2001-26

 

The Municipality has received comments pertaining to the provisions relating to the expansion of Non-Complying Buildings in the Shoreline Residential (RS) Zone.  The proposed amendment is intended to clarify these provisions by eliminating the height restrictions for non-complying buildings as they presently exist in the Zoning By-law, and to define “Reconstruction” to reduce any further confusion.

 

 

The purpose of the By-law Amendment is to clarify the provisions of the Zoning By-law as they pertain to the expansion of Non-Complying Buildings and to include a definition for “Reconstruction”.

 

The effect of this By-law Amendment is to eliminate the restriction of increasing the height of a non-complying building.

 

Council will be holding a public meeting under Section 34 of the Planning Act to present the draft amendment and to seek public comments on:

A copy of the proposed amendments is available on the Municipality’s website at www.magnetawan.com

The amendments affect all of the Municipality of Magnetawan and therefore no key map has been provided with this Notice.  Hard copies of the document are available for review at the Municipal Office.

Please note that if a person or public body does not make oral submissions at a public meeting or make written submissions to Council before the proposed By-law is approved, the person or public body is not entitled to appeal the decision of Council to the Ontario Municipal Board.

Also note that if a person or public body does not make oral submissions at a public meeting or make written submissions to Council before the proposed By-law is approved, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.

THE CORPORATION OF THE MUNICIPALITY OF MAGNETAWAN

BY-LAW 2012 – _______

Being a By-law to amend provisions concerning

Non-Complying Buildings and to update the Definitions Section

to this By-law

 

WHEREAS By-law No. 2001-26 as amended is the Zoning By-law of the Corporation of the Municipality of Magnetawan; and,

 

AND WHEREAS there are certain changes that are required to the provisions for Non-Complying Buildings and the Definitions, and Council deems it appropriate to make these minor changes; and,

 

AND WHEREAS authority is granted pursuant to Sections 34 of the Planning Act, R.S.O. 1990 to enact such amendments;

 

NOW THEREFORE be it enacted as a By-law of the Corporation of the Municipality of Magnetawan the following:

 

 

  1. Section 3.18 is hereby amended by deleting Table 1 and by replacing it with the following and by deleting Footnote (2) and by renumbering the remaining footnotes accordingly and be deleting the number “5” after the word “Column” in Footnote 2 and replacing with the number “4”.

  1. Section 3.18 b) is hereby amended by deleting the words “height or” after the word “in” and before the word “volume”.

 

  1. Section 5 is hereby amended by adding the following and by renumbering the remaining subsections accordingly:

 

5.194  Reconstruction

Shall mean the act of repairing, restoring or renovating more than 50% of an existing building to a safe or better condition but shall not constitute the demolition and replacement of a building or structure.

 

This By-law shall come into force and effect upon the date of passage hereof and take effect on the last day after the last day for filing appeals in accordance with the provisions of the Planning Act, R.S.O. 1990, c.P.13.
