Planning on Buying or Selling  a property?  Request a Property Information Report

Before making a purchase of land or prior to listing your property for sale, a Property Information Report can be requested. This Report will provide information specific to the property and will touch on Zoning and known Building Information.

Please know, the Municipality does not provide registered surveys of land, these can be obtained through ONLAND Registry at www.onland.ca/ui/


Planning Act Applications

Effective September 1, 2024, the Municipality was granted authority for Planning Act Applications, these include severances, plan of subdivision, boundary adjustments, minor variances and zoning amendments.   The Council for the Municipality of Magnetawan have been by by-law, appointed as the Committee of Adjustment.

The Municipality encourages residents to consult with Staff before making a Planning Act application.  An initial, informal consultation with Staff can provide an opportunity to give input on the development proposal early in the process, before the applicant commits time and funds. 


During this initial Staff consultation, Staff may recommend the applicant seek formal guidance from a Planner regarding the proposal.  Should an applicant wish to proceed with the Municipal Planner pre-consultation a fee will be required.

Additionally, the Municipality encourages residents to review relevant planning policies prior to a submission. Policies include the Municipalitys Zoning By-law, Official Plan and the Provinces Policy Statement. All these polices can be found here, on the Planning and Zoning page.  

A complete application, once received, is subject to legislative requirements that include, public notice, a public meeting, an appeal period, and in the case of severance applications, a two year time period to meet all applicable conditions.  Applications will appear before the Committee of Adjustment and will be accompanied by either a Staff Report or a Planners Report.  A decision to support, defer or deny an application is made during the public meeting.

Housekeeping By-law


Zoning By-Law:

The Municipality's Comprehensive Zoning By-law identifies the different land use zones with detailed maps and  provides information on permitted uses as well as:

  • How land may be used
  • Where buildings and other structures can be located.
  • The types of buildings that are permitted and how they may be used.
  • Lot sizes, dimensions, setbacks, etc.

Construction or new development that does not comply with a Zoning By-Law is not permitted.  


 

Official Plan:

The Municipality's Official Plan is a blueprint for the Municipality.  It guides all of the Magnetawan's planning decisions - all development must conform with the Plan. 


Minor Variance:

When the Municipality is considering a minor variance application, the four tests as prescribed by Section 45(1) of the Planning Act are applied to determine if the minor variance should be approved.
The four tests are:

  • Is the application minor in nature?
  • Is it desirable for the appropriate development or use of the land, building or structure?
  • Is it in keeping with the general intent and purpose of the Zoning By-law?
  • Is it in keeping with the general intent and purpose of the Official Plan?

PLANNING ACT APPLICATIONS

 If you wish to develop your lands and discover that you are not in compliance with either the Zoning By-law or Official Plan, you can make an application for an amendment to either Plan.
